EASYTRIP Terms of Use

In order for you to use the “EASYTRIP Run & Walk” and related website and other services (hereinafter referred to as the “Service”) provided by Complot Corporation (hereinafter referred to as the “Management”), you are required to read and agree to these Terms of Use. Please note that by using the Service, you are deemed to have agreed to these Terms and Conditions and the Privacy Policy.

1.Definitions

The definitions of terms used in this Agreement are as follows

1-1. the Service
The Service and all related services (including “the Application,” “the Site,” and “the Contents” below) operated by the Company.

1-2. the Application
An application that enables the use of the Contents of the Service.

1-3. the Website
The website on which the Service’s Content is posted.

1-4. the Contents
A generic term for text, sound, still images, video, software programs, code, etc. (including posted information) provided on the Service.

1-5. user
All persons who use the Service.

1-6. registered user
A person who has completed user registration on the Site.

1-7. ID
A string of characters that a registered user uniquely possesses to use the Service.

1-8. password
A cipher set uniquely by the registered user in correspondence with the ID.

1-9. personal information
A generic term for information that can identify an individual, including address, name, occupation, telephone number, etc. (This service does not obtain a user’s address, real name, occupation, telephone number, etc. within the scope of normal expected use.)

1-10. registration information
A generic term for information registered by registered users on the Site (excluding information posted on the Site).

1-11. intellectual property
Intellectual Property shall include inventions, devices, designs, works and other items produced by human creative activity (including discovered or elucidated laws or phenomena of nature that have industrial applicability), trademarks, trade names and other items indicating goods or services used in business activities, and trade secrets and other technical or business information useful in business activities. 1-12. technical or business information useful for business activities

Patent rights, utility model rights, breeder’s rights, design rights, copyrights, trademark rights, and any other rights provided by law with respect to intellectual property or rights pertaining to legally protected interests.

2.agreement to these terms of use

2-1. Users may use the Service upon agreeing to these Terms of Use.

2-2. When a user downloads the Service to a smartphone or other information terminal and goes through the procedures for agreeing to these Terms of Use, a contract of use in accordance with the various provisions of these Terms of Use shall be established between the user and the operation.

2-3. if the user is a minor, the user shall obtain the consent of a person with parental authority or other legal representative, and use the Service under the responsibility of such person with parental authority or other legal representative.

2-4. If a minor user uses the Service by falsely claiming to have the consent of a legal representative even though he/she does not have such consent, by falsely claiming to be of legal age, or by using other fraudulent means to make the user believe that he/she is of legal capacity, all legal acts related to the Service cannot be revoked.

2-5. If a User who was a minor at the time of consenting to these Terms of Use uses the Service after reaching the age of majority, such User shall be deemed to have ratified any and all legal acts related to the Service.

3.Modification of Terms

3-1. The Operation may revise these Terms of Use at any time without the consent of the User, and the User shall consent to such revision without objection.

3-2. When this Agreement is revised, the Operation will notify the User in the manner prescribed by the Operation.

3-3. Revisions shall take effect from the time when the Operation gives notice in accordance with the preceding paragraph.

3-4. Users will be deemed to have agreed to the revised Terms of Service without objection when they use the Service after the revision of the Terms of Service.

4.procedures for use of the service

4-1. Those who wish to use the Service (hereinafter referred to as “Users”) must agree to the Terms of Use and start using the Service in the prescribed manner.

4-2. The person who starts using the Service becomes a User from the time the Service confirms the start of use of the Service and issues an ID.

4-3. The operation will provide users with notices, advertisements, and other information on the application and the official website of the Service. Please understand this beforehand.

4-4. the Operation may not approve the use of the Service if any of the following conditions apply to a prospective registrant

(i) The prospective member applies for membership without following the procedures specified by the Management.

(ii) If the prospective member has previously been terminated for violating these Terms of Use or any other terms of use stipulated by the Management.

(iii) In the event that the Management deems that the applicant is using the Service in a dishonest manner.

(iv) When a prospective registrant has registered information that is not his/her own.

(v) In any other cases where we deem the applicant to be inappropriate.

5.account management

5-1. Users shall voluntarily register and manage the information registered for use (hereinafter referred to as “registered information”, including ID, password, etc.) at their own risk, and shall be fully responsible for all actions and consequences arising from the use of their account. Users shall not allow any third party to use their registration information, or lend, transfer, change the name of, or sell their registration information.

5-2. In the event that a user uses the Service based on the registration information, the Operation shall deem that the person who registered for the Service has used the Service, and any and all responsibility for the results and related matters arising from such use shall belong to the person who registered for the Service.

5-3. In the event that the unauthorized use of the registration information causes damage to the operation or a third party, the user shall be responsible for compensating for such damage.

5-4. the user shall manage the registration information at the user’s own responsibility, and the operation shall not be liable for any disadvantage or damage incurred by the user due to inaccuracy or falsehood of the registration information.

5-5. In the event that a user discovers that his/her registration information has been stolen or used by a third party, the user shall immediately notify the Operation and follow the Operation’s instructions.

6.Handling of Personal Information, etc.

Personal information and user information registered or provided by users in connection with the use of this service will be handled and managed appropriately in accordance with the “EASYTRIP Service Privacy Policy and Cookie Policy” separately stipulated by this operation.

7.Prohibited Acts

The following acts are prohibited in the use of the Service. If the Management deems that a User has violated any of the prohibited acts, the Management may take any measures that it deems necessary, such as suspending the User’s account or terminating the User’s membership.

7-1. infringement of intellectual property rights of the Operation or a third party

7-2. Any act that defames or slanders the honor or credibility of the Operation or a third party, or makes discriminatory remarks or slanderous statements.

7-3. acts that infringe or may infringe the property of the Operation or a third party

7-4. acts that cause economic damage to the Operation or a third party

7-5. acts that threaten the operation or a third party

7-6. acts that use or induce computer viruses or harmful programs

7-7. act of placing an excessive load on the infrastructure facilities of this service

7-8.attacks against the server, system, or security of this site

7-9. attempting to access the Service by a method other than the interface provided by the Operation, or using a modified program or interface to use the Service

7-10. in addition to the above, acts that this operation deems inappropriate

8. Limitation of Liability and Disclaimer

the operation operates the service on an “as is” and “as available” basis. to the fullest extent permitted by applicable law, the operation disclaims and disclaims all warranties of any kind, including any express or implied warranties. disclaimers include, but are not limited to, those of merchantability, fitness for a particular purpose, non-infringement, and damages related to trade, use, or business.

to the maximum extent permitted by applicable law, the operation shall not be liable for any indirect, special, incidental, punitive, or consequential damages (including, but not limited to, lost profits, sales, or data) arising out of or in connection with the service. the same applies even if these damages could have been advised of or arise under any cause or theory of liability (including, but not limited to, contract law, general damages, or any other theory of liability).

8-1. the operation shall not be liable for any damage caused by modification, interruption, or termination of the service.

8-2. The Operation shall not be involved in, and shall not be liable for, the user’s environment for using the Service. 8-3.

8-3. the operation does not warrant that the service is fit for the user’s specific purpose, has the expected functionality, commercial value, accuracy, or usefulness, or that the user’s use of the service complies with applicable laws and regulations or internal rules of any industry association.

8-4. The user acknowledges in advance that the Operation does not guarantee that the Service is compatible with all information terminals, and that problems may arise in the operation of the Service as a result of upgrades to the operating system (OS) version of the information terminal used to use the Service. The Management does not guarantee that the problem will be solved by the modification of the program, etc. performed by the Management in the event that such a problem arises.

8-5. The user acknowledges in advance that the use of part or all of the Service may be restricted due to changes in the terms of use or operating policies of service stores such as AppStore and Google Play.

8-6. The Operation shall not be liable for any direct or indirect damages incurred by the User as a result of the use of the Service.

8-7. the Operation shall not be liable for any loss of opportunity, business interruption, or other damages (including indirect damages and lost profits) incurred by users or other third parties, even if the Operation has been notified of the possibility of such damages in advance.

8-8. The provision 8-1 of the preceding paragraph does not apply in the event that the operation has committed intentional or gross negligence or the contract falls under the category of consumer under the Consumer Contract Act.

8-9. even if the preceding paragraph applies, TMG shall not be liable for any damages arising from special circumstances caused by a user’s act of negligence (excluding gross negligence).

8-10. In the event that the Operation is liable for damages in connection with the use of the Service, the Operation shall be liable for damages only within the scope of the usage fees received from the User for the month in which such damages occurred. In addition, even if the claim for damages is retroactive from the current month, the period of time that can be traced back from the claim by the user shall be up to 12 months, and any period longer than that shall not be subject to compensation.

8-11. The operation is not responsible for any disputes or problems that occur between users or between users and other users. 8-11. In the event of a dispute between Users or between Users and other Users, the dispute shall be resolved between the parties concerned, and no claim shall be made against the Management.

8-12. in the event that a user causes damage to another user or has a dispute with a third party in relation to the use of the Service, the user shall compensate for the damage or resolve the dispute at the user’s own expense and responsibility, and shall guarantee not to cause any trouble or damage to the Operation.

8-13.in the event that a third party claims damages from the Operation due to the User’s actions, the User shall settle such claim at the User’s own expense (including attorney’s fees) and responsibility. In the event that the Operation pays a third party compensation for damages, the User shall pay all expenses (including attorney’s fees and lost profits) to the Operation, including said compensation.

8-14. In the event that a User causes damage to the Operation in relation to the use of the Service, the User shall compensate the Operation for such damage (including legal fees and attorney’s fees) at the User’s own expense and responsibility.

9.Advertisements

Users understand and agree that advertisements may be posted on the Service, and that advertisements may be posted by the Management or affiliated third parties. The format and scope of advertisements on the Service may be changed by the Management at any time.

10.Various ways of use and sharing

In principle, this service is intended for personal use only. The contents of these Terms of Use are intended for personal use only. However, in principle, we do not prohibit the use of this service in a way that creates a positive impression on others. (However, any activity or action that is intended to create a negative impression is prohibited and may be subject to legal action, as it falls under the prohibited activities in these Terms of Use.

10-1.Examples of use that do not require permission from the management
In principle, you can use the service as long as you use it in the way it was originally intended to be used and in a way that makes a good impression on the user and all those around him or her who are affected by it.
・Gymnasium use (in addition to personal use, commercial use as a service of the gymnasium is also possible)
・Use in nursing homes, long-term care facilities, hospitals, etc. (besides personal use, there is no problem with commercial use)
・Distribution and introduction of play videos, still images, etc. (content must not create a negative impression)
・Use as background material for processing to create works such as cartoons, animated works, use for still images, etc.(However, when permission to use individual buildings, etc. is required, users are requested to contact the rights holders individually. Also, please remove any characters that appear in the video.)

10-2.Examples of items requiring approval and confirmation for our operation
If there is a possibility of giving a negative impression, please confirm with our management from the official website.
・Cases in which more than one person participates in the distribution to comment on the service.(Especially real-time distribution and public airwaves. We will not permit this if there is a possibility of damaging the reputation of our service.)
・Cases for large-scale events, etc.

10-3.Examples of non-permitted uses
・How to use a single account for multiple users
・In cases where this application is used to display videos or still images prepared by the user, displaying and publishing contents that are illegal, such as violence, discrimination, sexual content, or religious issues, or contents that may cause discomfort or awareness of problems among those who view such contents.
・Attempting to use the Service to identify, collect, or disseminate personal information (including images within this application)
・Any use of the Service for purposes other than its original use, including modification, alteration, refactoring, etc., or diversion of the source code.
・Potentially hazardous use

Users are solely responsible for any problems or troubles that may occur in connection with the use of this service, and our management assumes no responsibility for any problems or troubles that may occur in connection with such use. Please use this service with this understanding.

11.Cancellation, termination, or modification of this service

The user may terminate use of this application by deleting it at any time.

The Management reserves the right, at its sole discretion, to revoke a user’s eligibility to use the Service at any time and for any reason, including, but not limited to, the following cases This includes, but is not limited to, the following cases

・If the user does not meet the eligibility requirements

・When a user has not used the Service for an extended period of time

・If the user violates the Terms of Service, applicable laws, or regulations

・In the event that this operation determines that the user has committed a falsehood, forgery, fraud, or has misused this service.

・If you have received in-app currency, points, or rewards due to error, fraud, or misrepresentation, the Operation may cancel any or all of your in-app currency, points, or rewards.

The contents of this service are subject to change at the discretion of this operation. The content of this service may be affected by current trends, legal decisions in various countries, or requests from rights holders. In such cases, the operation may change or delete the contents. Users should be aware that these changes or deletions may occur, and should be mindful of this when using the Service. Changes may also occur in the method of obtaining or purchasing the Service, as well as in the fees charged. While our operation strives to make the Service available at a low cost to users, please be aware that prices and costs are subject to change due to server costs, electricity costs, and other reasons. Any changes that may affect users will be notified in advance on the official website.

The storage of data using this service is not permanent. The operation stores data in accordance with the legal requirements and privacy policies of each country. Not all of the data generated by the use of the Service will be stored. The operation cannot provide any guarantees for data outside the scope of the contract. Please keep these points in mind when using the Service.

If the user or the Management cancels the user’s eligibility to use the Service, the user will lose his/her accumulated points, activity history, and purchase history. If a user voluntarily terminates his/her use of the Service, the user may re-register by re-joining the Service. However, upon re-registration, the points, activity history, and purchase history previously earned will not be transferred to the new account.

The decision of the Management is final in all matters concerning the operation of the Service. The Management reserves the right to modify or cancel the Service at any time. In the event of any modification of these Terms of Service, the Management will notify users by posting a new version of these Terms of Service. The modified Terms of Use shall be effective as of the date of modification. By continuing to use the Service, the user agrees to the modified Terms of Use.

12.Transfer of Rights

12-1. The User shall not assign his/her position under these Terms and Conditions or any of his/her rights or obligations under these Terms and Conditions, in whole or in part, to any third party without the written consent of the Operation.

12-2. The Management may transfer all or part of the Service to a third party at its own discretion. In such case, all rights related to the Service, including the user’s account, will be transferred to the transferee to the extent of the rights transferred.

13.separability

If any provision of these Terms and Conditions, or any part thereof, is held invalid or unenforceable under the Consumer Contract Act or any other law, the remaining provisions of these Terms and Conditions and the remainder of any provision held invalid or unenforceable shall remain in full force and effect.

14.How to contact our management

Users are requested to contact the operation by using the inquiry form provided in the appropriate place in the service or on the website operated by the operation, or by any other method separately designated by the operation.

Inquiries will be responded to in the order received, so it may take some time before a reply is given. Please understand that it may take some time for us to reply to your inquiry.

15.Other

The decision of the Management is final in all matters concerning the operation of the Service. The Management is not responsible for any communication problems of any kind related to the Service. The Operation shall not be liable for any delay or failure of performance, in whole or in part, due to force majeure. If any provision of this Agreement is found to be illegal, invalid, or unenforceable, such provision will be deemed immediately severed from this Agreement and will not affect the validity or enforceability of any other surviving provisions. The failure of the Operation to enforce any right or provision of these Terms and Conditions shall not limit such right or provision in the future. No modification or amendment of this Agreement may be made by anyone other than authorized personnel of the Operation. The Operation may assign its rights and obligations under this Agreement in the event of a merger, business transfer, stock transfer, legal execution, or otherwise.

16.Governing law, court of jurisdiction

16-1.All disputes and questions concerning the validity of this Agreement or the interpretation, validity and enforceability of the Operation’s rights and obligations shall be governed by, construed and resolved in accordance with the laws of Japan.

16-2.Any controversy, lawsuit, or other dispute between the operation and users or other parties concerned shall be settled at the Tokyo Summary Court or the Tokyo District Court as the court of exclusive jurisdiction, depending on the amount of the suit.
